Este estudio analiza el artículo 146 del Código Orgánico Integral Penal (COIP) de Ecuador, esta trata sobre el homicidio culposo por práctica profesional equivocada. La mala praxis médica es un problema grave en el sistema de salud de Ecuador, y la interpretación inadecuada de este artículo ha generado confusión en los procesos legales relacionados. El objeto de la investigación es analizar la normativa del artículo 146 del COIP y las lagunas de interpretación jurídica para determinar la culpabilidad o inocencia de (...) los profesionales de la salud. Para ello, se emplearán métodos comparativos e históricos, que incluyen revisión bibliográfica, análisis de contenido del artículo 146. Los resultados esperados son demostrar las dudas razonables en la prueba del delito de mala praxis, resaltar la importancia de la bioética en los procedimientos legales. Este estudio busca contribuir a una mejor comprensión del marco legal y brindar ideas para la resolución de casos de mala praxis y homicidio culposo en Ecuador. (shrink)

In futsal there are two referees on the playing court and their capacity to respond to physical and physiological demands imposed during the game is essential for the success. The futsal characteristics such as size pitch, referees position and rules of games or type of league could impose specific physical efforts probably. The aim of this study were to analyze the physical demands of eight elite referees from seven matches of Spanish Futsal Cup 2020. The physical activity of each referee (...) during the match was monitored with a Local Positioning System, which was installed on futsal pitch where the matches were played. The data differences were evaluated as Paired-Samples T-Test procedure. The results revealed a similar total distance between halves. The zone 3 distance showed a significative decrease during the match in comparison to the first and second halves. The number of high-intensity acceleration and deceleration decreased in the second half of the match. Therefore, the use of the tracking device to monitoring physical performance provides knowledge of the specific activity profile from futsal referees. Sanchez and Sanchez have selected, edited, translated, and introduced some of the most influential texts in Mexican philosophy, which constitute a unique and robust tradition that will challenge and complicate traditional conceptions of philosophy. The texts collected here are organized chronologically and represent a period of Mexican thought and culture that emerged from the Mexican Revolution of 1910 and which culminated in la filosofia de lo mexicano (the philosophy of Mexicanness). Though the selections reflect on a variety of philosophical questions, (...) collectively they represent a growing tendency to take seriously the question of Mexican national identity as a philosophical question--especially given the complexities of Mexico's indigenous and European ancestries, a history of colonialism, and a growing dependency on foreign money and culture. More than an attempt to describe the national character, however, the texts gathered here represent an optimistic period in Mexican philosophy that aimed to affirm Mexican culture and philosophy as a valuable, if not urgent, contribution to universal culture. We used 7,415 advertisements published in Spain to analyze traits sought/offered by men and women from different age groups. Findings regarding age, socioeconomic status, and physical attractiveness requirements support evolutionary predictions about mate preferences. However, changes in trait preferences among women under 40 appear to be contingent on Spain’s socioeconomic transformation. Women under 40 seek mainly physical attractiveness in men, whereas those over 40 seek mainly socioeconomic status. The trait most sought by men in all age groups is physical attractiveness. (...) Traits sought and offered by advertisers may be conditioned by the personal situation of the advertiser. Mean age of advertisers (around their forties) and Spain’s social indicators suggest that the majority of advertisers have been unsuccessful in the mating arena at the conventional age. (shrink)

Adults (more than 18 years old) are likely to reproduce the habits that they acquired during childhood and adolescence (from 6 to 16 years old). For that reason, teachers and parents have the responsibility to promote an active and healthy lifestyle in children and adolescents. Even though every school subject should promote healthy activities, Physical Education (PE) is the most important subject to foster well-being habits associated to healthy lifestyle during sport practice and other kinds of active tasks. Indeed, there (...) are many factors that influence the acquisition of healthy habits that should be taken into account when programs and activities are implemented in both educational and extracurricular context. In this sense, psychological and social factors are of utmost importance to achieve optimal experiences for an active and healthy lifestyle. However, due to the myriad of studies analyzing different factors in different contexts, there could be confusion when programs and pedagogical strategies are applied in educational or extracurricular contexts. The objective of this investigation is to analyze the state of art of the psychosocial factors which influence the engagement in physical activities and sport practice. The keywords used in this review were mainly: ‘Self-Determination Theory’, ‘motivation’, ‘Psychological need satisfaction, ‘physical activity and sport engagement’, ‘Elementary Education’, ‘Secondary Education’, ‘Physical Education’. The articles were selected according to the following criteria: (a) peer-reviewed original research published in international journals indexed in JCR or SJR, (b) published in English or Spanish, (c) about psychosocial factors which influence the physical activity and sport engagement, (b) in educational or extracurricular context. Research articles selected were found through nine databases. It was observed that physical activities and sport practice engagement are closely related to psychological factors. In particularly, intrinsic motivation was able to determine the active participation in any activity, including physical activity and sport practice during the implementation of Small-Sided Games and other kinds of pedagogical strategies (e.g., Pedagogical Models). Motivation was also closely related to flow state. Finally, these variables should be considered in order to organize effective programs to promote an active and healthy lifestyle in Physical Education classes. (shrink)

This paper presents the design, simulation, and experimental verification of the fractional-order multiscroll Lü chaotic system. We base them on op-amp-based approximations of fractional-order integrators and saturated series of nonlinear functions. The integrators are first-order active realizations tuned to reduce the inaccuracy of the frequency response. By an exponential curve fitting, we got a convenient design equation for realizing fractional-order integrators of orders from 0.1 to 0.95. The results include simulations in SPICE of the mathematical description and the electronic implementation (...) and experimental measurements that confirm them. Monte Carlo and sensitivity tests revealed a robust realization. Contrary to its passive counterparts, the suggested realizations significantly reduce design and implementation efforts by favoring resistors and capacitors with commercial values and reducing hardware requirements. Habermas’s translation proviso aims to legitimize religious argumentation in the informal part of the public sphere while requiring religious citizens to express their arguments in the formal part of the public sphere using a universal (secular) language. By considering secular scholars Gonzalo Scivoletto’s and Javier Aguirre’s critiques of the meaning of “translation,” this article highlights the inconsistency of the proviso as manifested in its application to the religious concept of tzimtzum (“divine contraction”), from which Habermas attempts to extract a secular (...) worldview and moral intuitions that contradict the beliefs of religious citizens, thus undermining the reassessment of religion in the public sphere. A lo largo de la historia, la filosofía ha situado gran parte del foco de su quehacer en el constructo intelectual de sistemas de pensamiento que profundizaran en el análisis del mundo. Si embargo, existe una tendencia marginal, dentro de la tradición filosófica, que apuesta por acercarse a la filosofía como una disciplina práctica. En este artículo trataremos de focalizar la investigación en dos pensadores, separados por más de dos mil años, que apostaron por situar la praxis en el epicentro (...) de la filosofía: Pirrón de Élide y Matthew Lipman. El primero dio lugar a un escepticismo donde la ejemplaridad del acto configuraba la doctrina. El segundo, Matthew Lipman, diseñó una metodología de filosofía para niños que ensalza la praxis comunitaria como eje desde el que fundamentar el aprendizaje de la filosofía. Cada uno, desde diferentes planos, el individual por parte de Pirrón y el colectivo en el caso de Lipman, han sido esenciales para poner el valor el sentido práctico de la filosofía. Nos hemos acostumbrado a considerar como normales una serie de situaciones de injusticia extrema que son fuente de miseria y esterilización de las posibilidades humanas de vastos sectores de la población mundial. El presente artículo trata de mostrar que tales situaciones no resultan de la violación de principios éticos fundamentales por parte de algunos individuos u organizaciones aisladas, sino, justamente, de la aplicación de los criterios éticos que prevalecen hoy en la práctica económica y política. La vigencia de éstos se (...) debe a que convienen a los intereses de los países y grupos económicos que dominan el escenario global, quienes los aprovechan de manera ideológica para mantener su poder, al margen del perjuicio que causan al desarrollo de las sociedades menos avanzadas económicamente. Many pragmatist and non-representational approaches to cognition, such as the enactivist, have focused on the relations between actions, affectivity, and habits from an intersubjective perspective. For those adopting such approaches, all these aspects are inextricably connected; however, many questions remain open regarding the dynamics by which they unfold and shape each other over time. This paper addresses a specific topic that has not received much attention: the impact on future behavior of not fulfilling possibilities for social interaction even though their (...) fulfillment is desirable within a given context. Inspired by Gibson’s theory of affordances and Dewey’s account of habits, these situations will be characterized as events where an agent does not act upon an inviting affordance for social interaction due to a conflict which he or she experiences between given concerns, needs, and social norms. This conflict leads to a sense of unfulfillment that may eventually bring about a crisis and revision of habits. Through specific examples, this work presents the potential impact of the connection between affordances, habits, and affectivity on everyday situations. It therefore represents an exploration of the common ground between pragmatism and enactivism and an attempt to contribute to a process-based approach to social interaction. (shrink)

The Coronavirus Covid 19 pandemic has produced terrible effects in the world economy and is shaking social and political stability around the world. The world of sport has obviously been severely affected by the pandemic, as authorities progressively canceled all level of competitions, including the 2020 Olympic Games in Tokyo. In Spain, the initial government-lockdown closed the Sports High-performance Centers, and many other sports facilities. In order to support athlete's health and performance at crises like these, an online questionnaire named (...) RECOVID-19, was designed to assess how athletes were living their lives during such periods of home confinement. The main purpose of the questionnaire was to assess the impact of prolongued confinement on athlete's psychological, emotional, and behavioral performance. One thousand, two hundred forty-eight athletes participated in the survey. They had the fllowing characteristics:, who compete at National and International level. Results showed that during the confinement period, those athletes who lacked motivation reported a higher level of stressful thoughts, more behavioral problems, and greater emotional upheaval. However, those athletes who accepted confinement measures as necessary, and were in favor of respecting the rules of social isolation, fostered positive emotional states such as feelings of friendship. In addition, the availability of some sport equipment together with the ability to continue some training, were protective factors against emotional stress, lack of motivation and behavioral problems; and they were associated with greater respect for, and adherence to, confinement rules. Gender differences, tested by multigroup analysis, revealed that coping activities were more often associated to negative emotional states among women, whereas the ongoing availability of training information and future conditions were equally protective factors for both genders. This study also showed that receiving coaching, support and completing frequent training routines seem to be valuable tools to prevent or reduce some of the harmful effects of isolation on athlete's emotional well-being. The conclusions derived from this research would possibly help sport authorities to design supporting policies and plans to support athletes and trainers in future disruptive health crises. (shrink)

Contemporary popular culture is riddled with references to Mexican drug cartels, narcos, and drug trafficking. In the United States, documentary filmmakers, journalists, academics, and politicians have taken note of the increasing threats to our security coming from a subculture that appears to feed on murder and brutality while being fed by a romanticism about power and capital. Carlos Alberto Sánchez uses Mexican narco-culture as a point of departure for thinking about the nature and limits of violence, culture, and (...) personhood. A Sense of Brutality argues that violent cultural modalities, of which narco-culture is but one, call into question our understanding of “violence” as a concept. The reality of narco-violence suggests that “violence” itself is insufficient to capture it, that we need to redeploy and reconceptualize “brutality” as a concept that better captures this reality. Brutality is more than violence, other to cruelty, and distinct from horror and terror—all concepts that are normally used interchangeably with brutality, but which, as the analysis suggests, ought not to be. In narco-culture, the normalization of brutality into everyday life is a condition upon which the absolute erasure or derealization of people is made possible. (shrink)

Freud no es simple abogado de lo irracional, sino que trata de encontrar también «la razón de la sinrazón» que los neuróticos expresan en sus síntomas, los cuales pretendió explicar hasta en sus más mínimos detalles. The aim of this paper is to present a process-based ontology of art following John Dewey’s concepts of experience and rhythm. I will adopt a pragmatist and embodied point of view within an adverbialist framework. I will defend the idea of an artistic way of experiencing – a subtype of aesthetic experience – as something which allows us to assign the ontological category of art to an object or event. The adverbial features of this artistic way of experiencing will be (...) characterized as being rhythmic in nature. This goal will be achieved in three steps. First, I will explain and elaborate on the concept of adverbialism. Second, the importance of rhythm in experience will be taken into account through a close reading of Dewey’s philosophy and by incorporating the nuances of the Pre-Socratic idea of rhuthmos, as well as some recent findings about brain and bodily oscillations from cognitive science. Third, to conclude I will propose four necessary but not sufficient features of the rhythmic engagement enacted while an artistic way of experiencing takes place: a necessary degree of object or event awareness, a positive feedback dynamic, a loosening of the sense of agency, and being attentionally demanding. This paper explores various notions of aesthetic affordance recently developed through embodied, situated and enactive approaches to aesthetic experience by Maria Brincker and Shaun Gallagher, and the similarities and differences between them and the idea of affective affordance put forward by Joel Krueger and Giovanna Colombetti. This discussion is a way to try to offer some answers to the question of what aesthetic affordances particularly afford compared to affective affordances. I will focus on the affordances that we perceive during various (...) aesthetic experiences in which we find ourselves more moved by the object, event or person(s) causing the experience than we had anticipated. I will argue that these experiences emerge as opportunities to carry out an active exploration of aspects of the narrative self that we feel is related to features of the experience; and that one particular brain network likely to be involved in these experiences – i.e. the default network – might help us to understand how these experiences meaningfully change our relationship with ourselves and with the social context of which we are a part. This paper traces the concept and phenomenon of generosity from Aristotle to Emannuel Levinas and beyond. The question motivating this investigation is: must the generous act be restricted by a rational calculation of correct, or prudent, giving? Answers to this question vary. Aristotle and Kant would answer in the affirmative, while Emerson and Levinas would not. The bulk of this paper is dedicated to Levinas's characterization of excessive generosity as a condition for the fundamental ethical relation, namely, the generous welcome (...) of the Other. I end by considering the phenomenon of generosity from the point of view of the mid‐20th century Mexican philosopher, Emilio Uranga. (shrink)

One challenge faced by aesthetics is the development of an account able to trace out the continuities and discontinuities between general experience and aesthetic experiences. Regarding this issue, in this paper, I present an enactive model of some raw cognitive dynamics that might drive the progressive emergence of aesthetic experiences from the stream of general experience. The framework is based on specific aspects of John Dewey’s pragmatist philosophy and embodied aesthetic theories, while also taking into account research in ecological psychology, (...) cognitive sciences, and dynamic systems theory. The model focuses on dynamically relevant nodes at the pre-reflective and the reflective side of experience that would work as nested rhythmic constraints at different cognitive timescales with the potential to shunt experiences toward the aesthetic in everyday situations. My proposal constitutes a way to explore aesthetic experiences from an enactive perspective that regards them as transformative events in which cognitive processes entrain and are entrained by changes taking place in the environment, the brain, and the body. This study examines the cultural roots of ethical conflicts in the global business environment. It begins with a brief look at worldviews on ethical behavior in general. Based on this, it is argued that an in-depth understanding of ethical conflicts has been hampered by an overreliance on Western models and viewpoints. Three common sources, or bases, of ethical conflicts are discussed as they relate to business practices, including conflicts over tastes and preferences, the relative importance of moral imperatives compared to (...) legal requirements, and people’s level of tolerance for different values among others. It is then argued that an understanding of ethical conflicts can be facilitated through different levels of understanding, including the meaning of universal values, the relationship between values and practices, and the existence of multiple levels of conflict within the same organizations or industries. These specific and interrelated ingredients in cross-cultural ethical conflicts form the basis for a broader discussion of the meaning of truth as it relates to such conflicts. The paper concludes with the need for more research that is cross-cultural and multidisciplinary in order to improve theory building and managerial practice. (shrink)

En segundo lugar, se plantea la confrontación con Kant, bajo la forma de la disputa entre «amor» e «imperativo». Situados así en el terreno de la ética, se consideran las relaciones entre amor y justicia, sirviéndonos ante todo de los análisis de Ricoeur, para abordar finalmente (...) lo que podríamos denominar «el amor a los fuera de la ley», apoyándonos en algunos personajes literarios de Dostoievski. The present paper tries to answer the question _Is religious education compatible with the purposes of liberal education?_ This work argues that it is possible, and desirable, that democratic states built on liberal ideals include religious education in all schools since increasing the number of options among which the future citizen may choose the conception of the good with which he or she wishes to live is a condition for autonomy as one of its educational purposes. However, the proposal is (...) not based on religious confessional education, which by itself does not satisfy the liberal educational goals, but is redefined from the common noahide principles compatible both religious confessions and non-religious views of morality and citizenship. The aim of this paper is to advance, within the framework of enactivism, towards a more radically embodied and situated theory of emotions and, in general, of affectivity. Its starting point is that of discussing the well-established notion of bodily resonance (Fuchs 2013, Fuchs & Koch 2014, Fuchs 2018) and the primordial affectivity approach (Colombetti 2014). I will incorporate John Dewey’s theory of emotions, and recent models and empirical finding from cognitive science on the relation between perception and bodily activity (...) (Azzalini, Rebollo & Tallon-Baudry 2019; Allen et al. 2019). The novel element proposed in this paper is taking into consideration the role of bodily oscillatory activity in the perceptual side of cognition through phenomena of relative coordination. This concept from dynamical systems theory allows for an enactivist view of emotions as temporal episodes triggered by a tension that affects the rhythmic interaction between brain, body, and environment. By defending the importance of this enacted rhythm, the body emerges as a truly active agent, gating and modulating affectivity during all the stages of the sensorimotor circuit from perception to action. This paper explores and expands upon Jorge Gracia's reasons for the apparent lack of Hispanics in US philosophy. The point is to explain the underrepresentation of Hispanics in philosophy, with a focus on a specific subgroup of Hispanics, namely, "homegrown" US Hispanics. This group wasentirely missing from the "established" ranks in Gracia's census. I propose a phenomenological explanation for this lack, rooted in my experience as ahomegrown US Hispanic. This experience gives rise to a sense of identity described as "post-immigrant." (...) Those of us in the American philosophical establishment who share this identity, or who feel its pull, desire but hesitate to fully and authentically engage philosophy and the philosophical life, where thisrequires an uncompromising insertion of our cultural and historical identity into what we write and teach. The reason for the absence of homegrown Hispanicphilosophers who are willing to engage issues related to their circumstance as Hispanics is what I call, "the post-immigrant fear.". (shrink)

I offer a phenomenological description of undocumented immigrant reason, provisionally understood as a sort of historical reason grounded on undocumented immigrant life. That is, the categories of undocumented immigrant reason are resources for undocumented immigrant existence and are inscribed in the historical memory of immigration (they are shared and communal), accessed by immigrants in stories, anecdotes, and interpersonal trauma. Abstracting from personal experience, testimony, popular culture, and elsewhere, I propose a fragmentary list of these categories of undocumented immigrant reason, a (...) list that includes journeying, crossing/nepantla, uncertainty/zozobra, nostalgia, and return. These categories, which structure undocumented immigrant reason, are reflected in beliefs and attitudes about migration, belonging, the contingency of life, the centrality of memory, and the meaning of death. Constitutive of immigrant rationality are beliefs and ways of being that lend meaning to immigrant life, including those beliefs and ways of being that place immigrants in closer proximity to fundamental human truths.
